Terms of Service

1. Who we are and what these terms cover
FairStream (fairstream.live, app.fairstream.live and the mobile apps) is operated by Happy Electronics s.r.o., company ID 278 79 782, registered in the Czech Republic ("we"). These terms govern use of the service, debate bookings, payments, cancellation and refunds. By using the service you agree to them.
2. Service description
FairStream is a tool for structured online debates: it automatically manages speaking order and equal answer time for everyone, streams live to third-party platforms (Facebook, YouTube) and produces a recording, a transcript and an automatic summary. FairStream is a neutral technical tool. It does not influence the content of a debate and does not support any political party or candidate.
3. Organiser account and guests
- A debate is created by an organiser with an account (Google, Facebook or e-mail). The organiser must be 18 or older and provide truthful information.
- Participants (guests) join via an invitation link without an account. They enter a name and confirm before entering that they are aware of streaming and recording.
- The organiser is responsible for whom they invite and is listed as the content controller of the debate.
- We may terminate an account for violating these terms.
4. Booking a debate: Flex and Guaranteed Slot
Current prices and parameters are always stated in the pricing page. These terms refer to it and set the binding principles.
4.1 Common to both classes
- One booking = one debate of up to 120 minutes of real room time from the scheduled start (Europe/Prague time). The 15-minute waiting room before the start is not counted. After the time plus a 10-minute grace period, streaming and recording stop.
- Both classes have the same live video and audio quality, the same time rules and the same participant limit (up to 10). Transcript and automatic summary are included only with the paid Guaranteed Slot booking.
- Time is measured by the server. A participant's connection loss neither pauses the debate nor grants extra time.
4.1a Rehearsal (CZK 0)
- Free for everyone, no slot and no card. Participants join via a link without registration.
- Lasts at most 20 minutes, is not streamed publicly and produces no recording, transcript or summary. Settings and invited participants stay saved for the real debate.
4.2 FairStream Flex (CZK 0)
- Bookings only in open community slots, published 7 days ahead.
- At most one active future booking per account. No guarantee of a specific day and time.
- Two consecutive organiser no-shows block new Flex bookings for 14 days.
- A running Flex debate is never terminated in favour of a paid booking.
4.3 FairStream Guaranteed Slot (paid booking)
- Booking from the priority calendar up to 60 days ahead. We guarantee already confirmed capacity in the chosen slot.
- We do not guarantee that any arbitrary slot is available. If we cannot provide a confirmed slot due to our capacity, we offer a replacement slot or a full refund.
- A paid booking does not buy extra answer time for one side, priority speaking order, removal of another participant, influence over questions outside the rules, or any political support from us.
5. Payments
- The price is shown in CZK excluding and including VAT (21%) before payment. Payment is a one-off card payment via Stripe. Nothing renews automatically.
- During checkout the slot is held for 15 minutes. If payment does not complete, the slot is released.
- A booking is confirmed only after payment is received; confirmation and receipt are sent by e-mail.
- We do not use credits or subscriptions. The previously offered credit model has been discontinued; no paid balances existed, so nothing is carried over.
6. Cancellation, rescheduling, no-show and refunds
Detailed rules are in the Cancellation and Refund Policy, which forms part of these terms. In short:
- Cancelling a paid booking 48 hours or more before the start: full refund.
- Cancelling less than 48 hours before the start: one free reschedule; without rescheduling the price is not refunded.
- Organiser no-show: no refund. Invited guests not joining, third-party platform failure or a participant's internet failure are not grounds for a refund.
- FairStream failure or unavailable confirmed capacity: replacement slot or full refund, at the organiser's choice.
7. Content, recording and licence
- The organiser and participants keep the rights to their content. You grant us a non-exclusive licence to process the content technically (transmission, streaming to chosen platforms, recording, transcription, automatic summary) to the extent needed to provide the service.
- Recording, audio, transcript and automatic summary are kept for 7 days after the debate ends and then deleted automatically. The organiser downloads them before then or deletes them earlier.
- The automatic summary is always labelled as machine-generated and is not an official statement of any participant. A summary produced from the organiser's custom instructions is labelled as custom.
- The organiser is responsible for the content of the debate, for informing participants and for the rights needed to stream on third-party platforms.
8. Prohibited content and use
- Illegal, abusive or hateful content, copyright infringement, harassment, spam.
- Impersonating another person or a candidate you are not.
- Abusing invitation links, disrupting the service, circumventing booking limits.
- We may remove content violating these terms and cancel the booking without compensation.
9. Political debates and transparency
- When creating a debate marked as political, the organiser states the commissioning party, a contact, the related election and municipality and, where applicable, who pays for the paid booking.
- We publish this information together with the time rules, the list of confirmed participants and the booking class on a stable public debate page that does not disappear after the debate without reason. Changes are time-stamped.
- We do not use targeting based on political opinions or special categories of personal data and do not build political profiles of visitors.
- The organiser is responsible for meeting any own obligations under EU Regulation 2024/900 on transparency of political advertising and Czech law.
10. Liability
- We provide the service with professional care; our commitments for paid bookings are set out in sections 4.3 and 6.
- We are not liable for the availability and behaviour of third-party platforms (Facebook, YouTube), for participants' connections or for the content of the debate.
- Our total liability towards the organiser is limited to the price paid for the affected booking. Statutory consumer rights are not affected.
11. Complaints and contact
Send complaints to support@fairstream.live with your booking number; we handle them within 30 days. Consumers may also contact the Czech Trade Inspection Authority (www.coi.cz).
12. Changes and governing law
We may change these terms; changes do not apply retroactively to already confirmed bookings. We notify significant changes by e-mail or in the service. These terms are governed by the law of the Czech Republic.
