1. Kdo jsme a co tyto podmínky upravují

Službu FairStream (web fairstream.live, aplikace app.fairstream.live a mobilní aplikace) provozuje Happy Electronics s.r.o., IČO 278 79 782, se sídlem v České republice (dále „my"). Tyto podmínky upravují používání služby, rezervaci debat, platby, storno a vrácení peněz. Používáním služby s nimi souhlasíte.

2. Popis služby

FairStream je nástroj pro strukturované online debaty: automaticky řídí pořadí řečníků a stejný čas odpovědi pro každého, umožňuje živé vysílání na platformy třetích stran (Facebook, YouTube), pořizuje záznam, přepis a automatický souhrn. FairStream je neutrální technický nástroj. Neovlivňuje obsah debaty a nepodporuje žádnou politickou stranu ani kandidáta.

3. Účet organizátora a hosté

  • Debatu zakládá organizátor s účtem (Google, Facebook nebo e-mail). Musí být starší 18 let a uvádět pravdivé údaje.
  • Účastníci (hosté) se připojují odkazem z pozvánky bez účtu. Uvedou jméno a před vstupem potvrdí, že vědí o vysílání a záznamu.
  • Organizátor odpovídá za to, koho pozve, a je uveden jako správce obsahu debaty.
  • Účet můžeme zrušit při porušení těchto podmínek.

4. Rezervace debaty: Zkouška nanečisto, Zdarma (dříve Flex) a Plus (dříve Jistý termín)

Aktuální ceny a parametry jsou vždy uvedeny v ceníku. Podmínky odkazují na ceník a stanoví závazné principy.

4.1 Společné pro obě třídy

  • Jedna rezervace = jedna debata do 30 minut (Zdarma) nebo 60 minut (Plus) skutečného času místnosti od plánovaného začátku (čas Europe/Prague). Čekárna 15 minut před začátkem se nepočítá. Po uplynutí a 10minutové rezervě se vysílání a záznam ukončí.
  • Obě třídy mají stejnou kvalitu živého obrazu a zvuku, stejná pravidla času a stejný počet účastníků (až 10). Přepis a automatický souhrn jsou součástí pouze placené rezervace Plus.
  • Čas měří server. Výpadek připojení jednoho účastníka nezastavuje debatu ani mu nepřidává čas navíc.

4.1a Zkouška nanečisto (0 Kč)

  • Zdarma pro každého, bez termínu a bez platební karty. Účastníci se připojují odkazem bez registrace.
  • Trvá nejvýše 20 minut, nevysílá se veřejně, nevzniká záznam, přepis ani souhrn. Nastavení a pozvaní účastníci zůstávají uložené pro ostrou debatu.

4.2 FairStream Zdarma (0 Kč)

  • Nabídka bezplatných termínů je omezená. Komunitní termíny zveřejňujeme 7 dní předem a rezervovat lze jen ty, které jsou právě volné.
  • Nejvýše jedna aktivní budoucí rezervace na účet.
  • Před potvrzením systém nabídne jen termíny, pro které má volnou kapacitu. Jakmile rezervaci potvrdíme, termín je pevně rezervovaný stejně jako placený. Potvrzenou rezervaci Zdarma nezrušíme ani nepřesuneme ve prospěch placené rezervace.
  • Pokud se organizátor dvakrát po sobě nepřipojí (no-show), nemůže 14 dní vytvořit novou rezervaci Zdarma.
  • Již běžící debata Zdarma není nikdy ukončena ve prospěch placené rezervace.

4.3 FairStream Plus (placená rezervace)

  • Rezervace z kalendáře Plus, který má vlastní termíny navíc, až 60 dní předem. Výhodou je, že volno najdete, i když jsou termíny zdarma rozebrané, a vhodný termín si zajistíte s větším předstihem. Potvrzená rezervace ale neplatí víc než potvrzená rezervace Zdarma: pevně rezervované jsou obě.
  • I v kalendáři Plus může být konkrétní termín už obsazený. Pokud potvrzený termín kvůli naší kapacitě nezajistíme, nabídneme náhradní termín nebo vrátíme cenu.
  • Placená rezervace nekupuje více času na odpověď pro jednu stranu, přednostní pořadí, odstranění jiného účastníka, ovlivnění otázek mimo pravidla ani jakoukoli politickou podporu z naší strany.

5. Platby

  • Cena je uvedena v CZK bez DPH i s DPH (21 %) před zaplacením. Ceny jsou stejné na webu, v aplikaci pro iPhone a iPad i v aplikaci pro Android. Každý nákup je jednorázový, nic se automaticky neobnovuje.
  • Na webu se platí kartou přes Stripe; prodávajícím je Happy Electronics s.r.o.
  • V aplikaci pro Android se platí přes Google Play; prodávajícím je Happy Electronics s.r.o., platbu přijímá Google. Storno a vrácení peněz u těchto nákupů upravuje bod 6 Pravidel storna a vrácení peněz.
  • V aplikaci pro iPhone a iPad se platí přes App Store: prodávajícím v App Storu je Petr Kolman (fyzická osoba), platbu přijímá Apple, cena odpovídá cenové úrovni App Storu a doklad posílá Apple. Storno a vrácení peněz u těchto nákupů upravuje bod 5 Pravidel storna a vrácení peněz.
  • Během placení držíme termín 15 minut. Pokud platba neproběhne, termín se uvolní.
  • Rezervace je potvrzena až po přijetí platby; potvrzení a doklad posíláme e-mailem (u nákupu v App Storu posílá doklad Apple).
  • Kromě rezervací prodáváme balíčky kreditů, tedy předplacený čas pro řízené diskuse a vysílání. Každý účet má každý měsíc 2 hodiny zdarma; kredity se čerpají až potom, a to po sekundách běžící relace. Zakoupené kredity platí 1 rok od nákupu. Balíčky se prodávají na webu i v obou aplikacích za ceny uvedené v ceníku. Vrácení peněz za balíčky upravuje bod 7 Pravidel storna a vrácení peněz.
  • Předplatné ani měsíční tarify v tuto chvíli nenabízíme. Od balíčků kreditů je oddělený kredit na jednu debatu Plus, který vzniká stornem nákupu z iOS aplikace (viz Pravidla storna).

6. Storno, přesun, no-show a vrácení peněz

Podrobná pravidla jsou v Pravidlech storna a vrácení peněz, která jsou součástí těchto podmínek. Stručně:

  • Storno placené rezervace 48 hodin a více před začátkem: vrácení celé ceny (u nákupu přes Google Play se peníze vracejí přes Google Play, u nákupu v iOS aplikaci kredit na další debatu Plus).
  • Storno méně než 48 hodin před začátkem: jeden bezplatný přesun; bez přesunu se cena nevrací.
  • Nepřipojení organizátora: cena se nevrací. Nepřipojení pozvaných hostů, chyba platformy třetí strany nebo internetu účastníka nejsou důvodem k vrácení.
  • Chyba FairStreamu nebo nedostupnost potvrzené kapacity: náhradní termín nebo vrácení celé ceny podle volby organizátora.

7. Obsah, záznam a licence

  • Organizátor a účastníci si zachovávají práva ke svému obsahu. Udělujete nám nevýhradní licenci k technickému zpracování obsahu (přenos, vysílání na zvolené platformy, záznam, přepis, automatický souhrn) v rozsahu nutném k poskytnutí služby.
  • Záznam, audio, přepis a automatický souhrn uchováváme 7 dní od konce debaty, poté je automaticky mažeme. Organizátor si je do té doby stáhne nebo je smaže dřív.
  • Automatický souhrn je vždy označen jako strojově vytvořený a není oficiálním stanoviskem žádného účastníka. Souhrn vytvořený podle vlastního zadání organizátora je označen jako vlastní.
  • Organizátor odpovídá za obsah debaty, za informování účastníků a za právní tituly k vysílání na platformách třetích stran.

8. Zakázaný obsah a použití

  • Nezákonný, urážlivý nebo nenávistný obsah, porušování autorských práv, obtěžování, spam.
  • Vydávání se za jinou osobu nebo za kandidáta, kterým nejste.
  • Zneužití pozvánkových odkazů, narušování služby, obcházení limitů rezervací.
  • Obsah porušující tyto podmínky můžeme odstranit a rezervaci zrušit bez náhrady.

9. Politické debaty a transparentnost

  • Při založení debaty označené jako politická organizátor uvede objednatele, kontakt, související volby a obec a případně, kdo hradí placenou rezervaci.
  • Tyto údaje spolu s pravidly času, seznamem potvrzených účastníků a třídou rezervace zveřejňujeme na stabilní veřejné stránce debaty, která po debatě nezmizí bez důvodu. Změny jsou časově označené.
  • Nepoužíváme cílení podle politických názorů ani zvláštních kategorií osobních údajů a nevytváříme politické profily návštěvníků.
  • Organizátor odpovídá za splnění případných vlastních povinností podle nařízení EU 2024/900 o transparentnosti politické reklamy a české legislativy.

10. Odpovědnost

  • Službu poskytujeme s odbornou péčí; závazky u placené rezervace jsou uvedeny v článcích 4.3 a 6.
  • Neodpovídáme za dostupnost a chování platforem třetích stran (Facebook, YouTube), za připojení účastníků ani za obsah debaty.
  • Naše celková odpovědnost vůči organizátorovi je omezena na cenu zaplacenou za dotčenou rezervaci. Zákonná práva spotřebitele tím nejsou dotčena.

11. Reklamace a kontakt

Reklamace posílejte na support@fairstream.live s číslem rezervace, vyřídíme je do 30 dnů. Spotřebitel se může obrátit i na Českou obchodní inspekci (www.coi.cz).

12. Změny podmínek a rozhodné právo

Podmínky můžeme změnit; změny neplatí zpětně pro již potvrzené rezervace. O významných změnách informujeme e-mailem nebo ve službě. Podmínky se řídí právem České republiky.

1. Who we are and what these terms cover

FairStream (fairstream.live, app.fairstream.live and the mobile apps) is operated by Happy Electronics s.r.o., company ID 278 79 782, registered in the Czech Republic ("we"). These terms govern use of the service, debate bookings, payments, cancellation and refunds. By using the service you agree to them.

2. Service description

FairStream is a tool for structured online debates: it automatically manages speaking order and equal answer time for everyone, streams live to third-party platforms (Facebook, YouTube) and produces a recording, a transcript and an automatic summary. FairStream is a neutral technical tool. It does not influence the content of a debate and does not support any political party or candidate.

3. Organiser account and guests

  • A debate is created by an organiser with an account (Google, Facebook or e-mail). The organiser must be 18 or older and provide truthful information.
  • Participants (guests) join via an invitation link without an account. They enter a name and confirm before entering that they are aware of streaming and recording.
  • The organiser is responsible for whom they invite and is listed as the content controller of the debate.
  • We may terminate an account for violating these terms.

4. Booking a debate: Free (formerly Flex) and Plus (formerly Guaranteed Slot)

Current prices and parameters are always stated in the pricing page. These terms refer to it and set the binding principles.

4.1 Common to both classes

  • One booking = one debate of up to 30 minutes (Free) or 60 minutes (Plus) of real room time from the scheduled start (Europe/Prague time). The 15-minute waiting room before the start is not counted. After the time plus a 10-minute grace period, streaming and recording stop.
  • Both classes have the same live video and audio quality, the same time rules and the same participant limit (up to 10). Transcript and automatic summary are included only with the paid Plus booking.
  • Time is measured by the server. A participant's connection loss neither pauses the debate nor grants extra time.

4.1a Rehearsal (CZK 0)

  • Free for everyone, no slot and no card. Participants join via a link without registration.
  • Lasts at most 20 minutes, is not streamed publicly and produces no recording, transcript or summary. Settings and invited participants stay saved for the real debate.

4.2 FairStream Free (CZK 0)

  • The number of free slots on offer is limited. Community slots are published 7 days ahead and only slots that are currently free can be booked.
  • At most one active future booking per account.
  • Before confirming, the system offers only slots for which capacity is available. Once we confirm the booking, the slot is firmly reserved, just like a paid one. We will not cancel or move a confirmed Free booking in favour of a paid booking.
  • Two consecutive organiser no-shows block new Free bookings for 14 days.
  • A running Free debate is never terminated in favour of a paid booking.

4.3 FairStream Plus (paid booking)

  • Booking from the Plus calendar, which has its own extra slots, up to 60 days ahead. The benefit is that you find a free time even when the free slots are taken, and you can secure a suitable slot further in advance. A confirmed paid booking is not firmer than a confirmed Free booking: both are firmly reserved.
  • A specific slot in the Plus calendar may also already be taken. If we cannot provide a confirmed slot due to our capacity, we offer a replacement slot or a full refund.
  • A paid booking does not buy extra answer time for one side, priority speaking order, removal of another participant, influence over questions outside the rules, or any political support from us.

5. Payments

  • The price is shown in CZK excluding and including VAT (21%) before payment. Prices are the same on the web, in the iPhone and iPad app and in the Android app. Every purchase is a one-off payment; nothing renews automatically.
  • On the web, payment is by card via Stripe; the seller is Happy Electronics s.r.o.
  • In the Android app, payment goes through Google Play; the seller is Happy Electronics s.r.o. and Google takes the payment. Cancellation and refunds for these purchases are covered by section 6 of the Cancellation and Refund Policy.
  • In the iPhone and iPad app, payment goes through the App Store: the seller on the App Store is Petr Kolman (a natural person), Apple takes the payment, the price follows the App Store price tier and Apple sends the receipt. Cancellation and refunds for these purchases are covered by section 5 of the Cancellation and Refund Policy.
  • During checkout the slot is held for 15 minutes. If payment does not complete, the slot is released.
  • A booking is confirmed only after payment is received; confirmation and receipt are sent by e-mail (for App Store purchases, Apple sends the receipt).
  • Besides bookings, we sell credit packs, i.e. prepaid time for moderated discussions and streams. Every account gets 2 free hours each month; credits are used only after that, charged per second of a running session. Purchased credits are valid for 1 year from purchase. Credit packs are sold on the web and in both apps at the prices shown on the pricing page. Refunds for credit packs are covered by section 7 of the Cancellation and Refund Policy.
  • We do not offer subscriptions or monthly plans at the moment. Separate from credit packs is the credit for one Plus debate created by cancelling a purchase made in the iOS app (see the Cancellation Policy).

6. Cancellation, rescheduling, no-show and refunds

Detailed rules are in the Cancellation and Refund Policy, which forms part of these terms. In short:

  • Cancelling a paid booking 48 hours or more before the start: full refund (for Google Play purchases the money is returned through Google Play; for purchases in the iOS app, a credit for another Plus debate).
  • Cancelling less than 48 hours before the start: one free reschedule; without rescheduling the price is not refunded.
  • Organiser no-show: no refund. Invited guests not joining, third-party platform failure or a participant's internet failure are not grounds for a refund.
  • FairStream failure or unavailable confirmed capacity: replacement slot or full refund, at the organiser's choice.

7. Content, recording and licence

  • The organiser and participants keep the rights to their content. You grant us a non-exclusive licence to process the content technically (transmission, streaming to chosen platforms, recording, transcription, automatic summary) to the extent needed to provide the service.
  • Recording, audio, transcript and automatic summary are kept for 7 days after the debate ends and then deleted automatically. The organiser downloads them before then or deletes them earlier.
  • The automatic summary is always labelled as machine-generated and is not an official statement of any participant. A summary produced from the organiser's custom instructions is labelled as custom.
  • The organiser is responsible for the content of the debate, for informing participants and for the rights needed to stream on third-party platforms.

8. Prohibited content and use

  • Illegal, abusive or hateful content, copyright infringement, harassment, spam.
  • Impersonating another person or a candidate you are not.
  • Abusing invitation links, disrupting the service, circumventing booking limits.
  • We may remove content violating these terms and cancel the booking without compensation.

9. Political debates and transparency

  • When creating a debate marked as political, the organiser states the commissioning party, a contact, the related election and municipality and, where applicable, who pays for the paid booking.
  • We publish this information together with the time rules, the list of confirmed participants and the booking class on a stable public debate page that does not disappear after the debate without reason. Changes are time-stamped.
  • We do not use targeting based on political opinions or special categories of personal data and do not build political profiles of visitors.
  • The organiser is responsible for meeting any own obligations under EU Regulation 2024/900 on transparency of political advertising and Czech law.

10. Liability

  • We provide the service with professional care; our commitments for paid bookings are set out in sections 4.3 and 6.
  • We are not liable for the availability and behaviour of third-party platforms (Facebook, YouTube), for participants' connections or for the content of the debate.
  • Our total liability towards the organiser is limited to the price paid for the affected booking. Statutory consumer rights are not affected.

11. Complaints and contact

Send complaints to support@fairstream.live with your booking number; we handle them within 30 days. Consumers may also contact the Czech Trade Inspection Authority (www.coi.cz).

12. Changes and governing law

We may change these terms; changes do not apply retroactively to already confirmed bookings. We notify significant changes by e-mail or in the service. These terms are governed by the law of the Czech Republic.
